1. Agreement to These Terms

These Terms of Service form a binding agreement between you and Agave Healthcare Tucson LLC, a professional services company operating a clinic intake hall at 5513 W 11000 N Ste 435, Highland - 84003-8012, United States (US). By visiting this website, sending a message to the intake desk, booking a visit or taking part in a scheduled sitting, you accept these terms in full.

If you do not accept these terms, please do not use the website or request coordination services. If you are acting for another person, you confirm that you have authority to accept these terms on that person behalf and to share information about that person with the intake hall.

These terms apply together with the Privacy Policy published on this website. Where the two documents differ on a question of records or data handling, the Privacy Policy controls for that question. Where they differ on a question about the service itself, these terms control.

2. About the Company and the Hall

Agave Healthcare Tucson LLC provides computer systems design and related professional services for the healthcare sector. Its public intake hall in Highland coordinates visit bookings, referral letters, plan reviews, laboratory result windows, wellness check reviews and follow-up call sittings.

Company: Agave Healthcare Tucson LLC

Address: 5513 W 11000 N Ste 435, Highland - 84003-8012, United States (US)

Email: call@agavetucson.lol

Telephone: +16088033169

Website: https://www.agavetucson.lol

The hall is a coordination desk and a professional office. It is not an emergency room and it is not a hospital. A person facing a medical emergency must contact local emergency services rather than the intake desk. The desk does not dispatch emergency response and does not monitor messages outside business hours.

3. Services Offered

The hall offers the following coordination services from the Highland clinic hall. Each service is described on the services page of this website, and the description on that page forms part of these terms.

  • Visit Booking Bays, which reserve a bay, a coordinator and a stated purpose for a visit.
  • Referral Letter Runs, which draft, check and release a letter to a named destination.
  • Plan Review Desks, which read a plan with the visitor and record the agreed actions.
  • Lab Result Windows, which explain a complete result set in plain language.
  • Wellness Check Reviews, which examine routines that keep a plan working.
  • Follow-up Call Sittings, which hold a scheduled call window with a written summary.

The company may add, change or withdraw a service from time to time. Where a change affects an existing booking, the desk will contact the visitor before the booking date and offer an equivalent sitting or a rebooking.

4. Eligibility and Visitor Duties

The website is intended for adults who are arranging their own coordination or coordination for a person in their care. A visitor using the website confirms that the information provided is accurate and complete to the best of that person knowledge.

A visitor agrees to attend a scheduled sitting on time, to bring the documents the desk has requested and to inform the desk promptly if a booking can no longer be kept. A visitor also agrees to treat the coordinator and other visitors with courtesy and to respect the quiet of the waiting rail.

Where a visitor names another person as an authorized contact, the visitor confirms that the named person has agreed to that arrangement. The desk may ask for the authority in writing before discussing a visit record with the named person.

The hall may decline to serve a visitor who arrives in a state that endangers staff or other visitors, who behaves abusively or who repeatedly provides false information. Any such decision is recorded in the register with the reason, and the visitor is told in writing.

5. Bookings and Scheduling

A booking is made at the front window, by telephone on +16088033169 or by email to call@agavetucson.lol. A booking is confirmed only when the desk has written back with the bay, the date, the arrival window and the name of the coordinator. A request that has not been confirmed is not a booking, and no bay is held for it.

Each bay carries a buffer of fifteen minutes on either side. The desk reserves the right to shorten or reschedule a sitting where a previous sitting runs long, where a safety concern arises or where a staff member is unavailable. In that case the desk will offer the next available window and will record the reason in the register.

A visitor who arrives more than fifteen minutes after the stated arrival window may be asked to wait for a later opening. The desk will make every reasonable effort to see the visitor on the same day, but a same day alternative is not guaranteed when the bays are full.

6. Referral Letters and Documents

A referral letter is drafted from the register and from the information the visitor provides. The visitor is responsible for the accuracy of the destination, the office name and any reference number supplied. The desk checks every date and name against the register, reads the letter aloud before signing and records the version that was released.

No letter is released until the visitor confirms the destination in writing. Once a letter has been released to a destination named by the visitor, the company cannot retrieve copies held by that destination. A visitor who has named a destination by mistake should notify the desk immediately so that a corrected letter can be prepared and a note added to the record.

The content of a referral letter reflects the information available at the time of drafting. The company does not guarantee that another office will accept a letter, schedule an appointment or reach a particular conclusion. Acceptance and scheduling remain the decision of the receiving office.

Documents provided by the visitor remain the property of the visitor. The company keeps a copy only for the period needed to complete the task and to answer a later question, as described in the Privacy Policy.

7. Lab Result Windows

A result window is opened only when the desk has received a complete set of results. The window is a scheduled appointment at the triage window in which a coordinator explains the figures in plain language and records the explanation. The explanation is a coordination service and is not a clinical opinion.

Visitors must not rely on the result window as a substitute for advice from a licensed clinician. Where a figure requires clinical interpretation, the coordinator will say so and will help the visitor book an appropriate follow-up. The company is not responsible for a clinical decision made by another office or by the visitor on the basis of a result explanation.

Results are never read to a person other than the visitor or a person the visitor has named in writing. The desk may contact the visitor directly when a result requires an urgent conversation, and it will record the time of that contact in the register.

8. Follow-up Call Sittings

A follow-up call sitting is a scheduled window in which a coordinator calls the visitor to review an agreed topic. The window, the name of the caller and the purpose of the call are confirmed in writing before the window opens.

The desk attempts the call twice within the window. If both attempts fail, the desk leaves a written note and rebooks the sitting with a fresh window. The desk does not dial repeatedly through the day, and visitors are asked not to rely on an unscheduled callback.

A call sitting may be recorded in a written summary of two or three sentences. The summary is part of the visit record and is handled in line with the Privacy Policy. Calls are not audio recorded unless the visitor is told in advance and agrees at the start of the call.

9. Acceptable Use of the Website

The website may be used for its intended purpose: reading about the intake hall, contacting the desk, booking a sitting and communicating about a visit. The following activities are not permitted.

  • Attempting to gain unauthorized access to any part of the website or its hosting environment.
  • Sending automated requests that place an unreasonable load on the server.
  • Using the contact form to send bulk messages, advertising or malicious code.
  • Impersonating another person or submitting information about a person without authority.
  • Copying the website for a competing service or presenting it as your own work.
  • Interfering with the security features of the website or with the register that supports the hall.
  • Using the website in a way that breaks any applicable law or regulation.

The company may block a network, an address or a person that breaches these rules. Where a breach appears to be criminal, the company may report it to the appropriate authority and may keep the relevant records for that purpose.

10. Intellectual Property

The text, layout, illustrations, stylesheet and code that make up this website are owned by Agave Healthcare Tucson LLC or are used under licence. The company name, the hall name and the visual design of the intake window are protected identifiers and may not be used in a way that suggests an affiliation that does not exist.

A visitor may print a page for personal use and may quote a short passage with a clear attribution. A visitor may not copy substantial parts of the website, republish the illustrations or reuse the stylesheet in another project without written permission.

Documents produced for a visitor, such as a referral letter or a review summary, belong to the visitor for personal use. The company keeps a copy for its records as described in the Privacy Policy, but it does not publish or resell those documents.

11. Third Party Offices and Links

This website may link to pages operated by other organizations, including specialist offices and public resources. Those pages are not controlled by the company, and the company does not endorse their content or guarantee their accuracy.

A visitor who follows an external link leaves this website and becomes subject to the terms and privacy notice of the other organization. The company is not responsible for a transaction, a booking or a disclosure that occurs on another website.

Where the intake desk contacts another office on behalf of a visitor, the desk acts only as a messenger. The receiving office applies its own policies, and the company cannot promise a particular response time or outcome from that office.

12. Information Accuracy and No Clinical Advice

The content of this website is provided for general information about the intake hall. It is written in good faith and reviewed periodically, but it is not clinical advice and it must not be used to diagnose a condition, to choose a treatment or to change a medication.

The company makes reasonable efforts to keep the service descriptions accurate. Even so, a description may lag behind a change in the hall routine. Where a description on the website conflicts with a written confirmation from the desk, the written confirmation controls.

A visitor who has a clinical question should raise it with a licensed clinician. The coordinator can help book a sitting and can explain what the desk can and cannot answer, but the coordinator does not replace a clinician.

13. Fees and Charges

The intake coordination services described on this website are currently offered without a separate coordination fee. Where a fee applies to a particular sitting, the desk will state the amount in writing before the booking is confirmed and will not add a charge afterwards.

A visitor remains responsible for any charge raised by another office, a laboratory or a transport provider. The company does not collect those charges and does not act as a billing agent for another organization.

If a fee is introduced for a service that was previously free, the change applies only to bookings confirmed after the notice is given. A booking made before the notice is honored under the terms that applied when it was confirmed.

14. Privacy and Records

Personal information is handled as described in the Privacy Policy published on this website. In summary, the company collects only what the intake desk needs, keeps it in a restricted register, shares it only with a destination the visitor names and deletes it at the end of the retention period.

A visitor may request access to the record, ask for a correction or request deletion. Those requests are handled by the privacy desk using the contact channels listed in these terms. Where a retention duty requires a record to be kept, the privacy desk will explain the duty and the date at which the record will be reviewed again.

The visitor is responsible for keeping contact details current. A booking confirmation, a result window notice or a call sitting summary sent to the last known address is treated as delivered unless it is returned as undeliverable.

15. Cancellation and Rebooking

A booking may be changed or cancelled up to the morning of the visit. The desk records the reason for a cancellation so that the hall can see which hours keep failing and can adjust the schedule. A same week rebooking is offered wherever capacity allows.

A visitor who does not attend a booking without notice may be asked to confirm the next booking by telephone. Repeated non-attendance may lead to a requirement that a booking be confirmed in a short window before the visit, so that bays are not held for hours that are unlikely to be used.

The company may cancel a sitting when the hall must close for safety reasons, when a coordinator is unavailable or when a document needed for the sitting has not arrived. In each case the desk will contact the visitor as soon as possible and will offer the next available window without charge.

16. Availability and Service Interruptions

The company aims to keep this website available at all times, but it does not promise uninterrupted access. Maintenance, a hosting fault, a network problem or a security incident may make the site unavailable for a period.

The website is a static set of pages and does not store submitted form content on a server. If the site is unavailable, a visitor can still reach the desk by telephone on +16088033169 or by email to call@agavetucson.lol. Messages sent while the site is down are not lost, because the desk reads them through the same email channel during business hours.

The company is not liable for a delay caused by an interruption that is outside its reasonable control, although it will make every reasonable effort to restore access and to reschedule any sitting that was affected.

17. Limitation of Liability

To the fullest extent permitted by law, Agave Healthcare Tucson LLC is not liable for indirect, incidental, special or consequential loss arising from the use of this website or from reliance on its content. This includes lost time, lost opportunity and the cost of arranging a substitute service.

The company is not liable for the acts or omissions of another office, a laboratory, a transport provider or any other organization that a visitor chooses to involve. The company is also not liable for a clinical decision made by a clinician, because the coordinator does not provide clinical care.

Where liability cannot be excluded by law, the total liability of the company for a claim connected with the website is limited to the amount the visitor paid to the company for the service that gave rise to the claim, or to one hundred United States dollars where no amount was paid. Nothing in these terms limits liability for fraud or for a matter that the law does not allow to be limited.

18. Indemnity

A visitor agrees to indemnify and hold harmless Agave Healthcare Tucson LLC and its staff against a claim, loss or expense that arises from the visitor breach of these terms, from inaccurate information supplied by the visitor or from the visitor use of the website in a way that harms another person.

This indemnity does not apply to the extent that the claim results from the negligence or wilful misconduct of the company. The company will notify the visitor of a claim covered by this section and will allow the visitor a reasonable opportunity to respond, while retaining control of its own defence.

19. Suspension and Termination

The company may suspend access to the website or decline further bookings where a visitor breaches these terms, behaves abusively or uses the hall in a way that endangers staff or other visitors. A suspension is recorded in the register with the reason and the date.

A suspension does not remove the rights a visitor has under the Privacy Policy. A visitor may still request a copy of the record, ask for a correction or ask for deletion, subject to the retention duties that apply to a professional services business.

These terms continue to apply after a suspension or after a visitor stops using the website, to the extent that a provision by its nature is intended to survive, including the provisions on intellectual property, liability, indemnity and governing law.

20. Complaints and Dispute Resolution

A visitor who is unhappy with a sitting should raise the concern with the coordinator first. Most concerns are settled in the room or within a short written exchange. If the concern cannot be settled with the coordinator, the visitor may ask for a review by the company director.

A written complaint should describe what happened, the date and time of the sitting and the outcome the visitor is seeking. The company will acknowledge the complaint within five business days and will provide a written response within thirty days.

Where a dispute cannot be resolved by discussion, the parties agree to attempt mediation in Utah before starting legal proceedings, except where a claim is urgent or where the law allows a party to proceed directly. The cost of mediation is shared equally unless the mediator decides otherwise.

21. Changes to These Terms

The company may update these terms when the hall routine changes, when a new service is introduced or when the law changes. Revised terms are posted on this page with a new effective date, and the table of contents is updated at the same time.

Where a change materially affects an existing booking, the desk will notify the visitor before the booking date and will explain the change in plain language. A visitor who does not accept the revised terms may cancel a future booking without charge.

Continuing to use the website or to request a sitting after revised terms are posted means that the revised terms apply to future interactions. A booking made before the revision continues to be governed by the terms that applied when it was confirmed.

22. Governing Law and Jurisdiction

These terms are governed by the laws of the State of Utah in the United States, without regard to conflict of law rules. A dispute that is not resolved through the complaints process or through mediation will be brought in a court of competent jurisdiction in Utah.

Nothing in this section prevents a consumer from relying on a mandatory protection provided by the law of the place where the consumer lives. Where such a protection applies, it prevails over this section to the extent required by that law.

The website is operated from the United States. A visitor who accesses the website from another country does so on that visitor own initiative and is responsible for compliance with local law.

23. General Provisions

These terms, together with the Privacy Policy and the service descriptions on the services page, form the entire agreement between the visitor and the company for the use of the website and the intake services.

If a provision of these terms is found to be unenforceable, that provision is limited to the minimum extent necessary and the remaining provisions continue in full force. A failure by the company to enforce a provision on one occasion is not a waiver of the right to enforce it later.

A visitor may not transfer rights or duties under these terms without the written consent of the company. The company may transfer its rights and duties to a successor organization that continues the intake hall, provided that the successor accepts these terms.

Headings are included for convenience only and do not affect the interpretation of a provision. References to writing include email and a printed page. References to a day mean a calendar day unless a business day is stated.

24. Contact and Notices

Notices to the company should be sent to the intake desk. Notices to a visitor are sent to the email address, postal address or telephone number recorded in the register. The company may send a notice by more than one channel where the first channel does not appear to have been received.

The desk answers written notices during business hours from Monday to Friday. A notice sent outside those hours is treated as received on the next business day. A notice about a scheduled sitting should name the sitting and the date so that the coordinator can act immediately.

These terms were prepared for the clinic intake hall of Agave Healthcare Tucson LLC in Highland, Utah and apply to every page of this website.
